Welcome to www.gamo.site (the “Site”), operated by GAMO (referred to as “we,” “us,” or “our”), a company based in Dubai, United Arab Emirates. GAMO specializes in the sale of car spare parts, accessories, and all related products for the automotive world. These Terms & Conditions (“Terms”) govern your access to and use of the Site, including any content, functionality, and services offered on or through the Site.
 
By accessing or using the Site, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not access or use the Site. These Terms are designed to comply with the applicable laws of the United Arab Emirates, particularly those governing e-commerce and consumer protection in Dubai, as well as international best practices for online retail.

1. Definitions

“Customer,” “You,” “Your”: Refers to the user or buyer of products and services from the Site.
•“Site,” “Website”: Refers to www.gamo.site.
•“Products”: Refers to car spare parts, accessories, and related automotive items sold on the Site.
•“Order”: Refers to a request made by you for Products available on the Site.

2. Eligibility

By using the Site, you represent that you are at least 18 years old and have the legal capacity to enter into a binding contract. If you are accessing or using the Site on behalf of a company or other legal entity, you represent that you have the authority to bind such entity to these Terms.

3. Account Registration

To access certain features of the Site, such as placing orders, you may need to register for an account. When you register, you agree to:

•Maintain the security of your password and identification.
•Promptly update your registration data and any other information you provide to us to keep it accurate, current, and complete.

4. Product Information and Availability

We strive to ensure that all details, descriptions, and prices of Products appearing on the Site are accurate. However, errors may occur. If we discover an error in the price of any Products you have ordered, we will inform you of this as soon as possible and give you the option of reconfirming your Order at the correct price or cancelling it. If we are unable to contact you, we will treat the Order as cancelled.
 
All Products are subject to availability. We reserve the right to limit the quantity of Products supplied. We also reserve the right to discontinue any Product at any time.

5. Pricing and Payment

All prices displayed on the Site are in AED (United Arab Emirates Dirham) unless otherwise specified. Prices are subject to change without notice. The total price of your Order will include the price of the Products plus any applicable taxes, shipping, and handling charges.
 
We accept various payment methods as indicated on the Site. By submitting an Order, you represent and warrant that you are authorized to use the designated payment method and authorize us to charge your Order to that payment method. All payment transactions are processed through secure third-party payment gateways.

6. Order Acceptance and Confirmation

Your Order constitutes an offer to purchase Products from us. All Orders are subject to acceptance by us. We will send you an email confirming receipt of your Order. This email is an acknowledgment that we have received your Order and does not constitute acceptance of your Order. A contract between us for the purchase of the Products will only be formed when we send you an email confirming that the Products have been dispatched.

7. Shipping and Delivery

We will arrange for the delivery of the Products to the address specified in your Order. Delivery times are estimates only and are not guaranteed. We are not responsible for delays caused by customs clearance, unforeseen circumstances, or third-party shipping carriers. Risk of loss and title for Products purchased from the Site pass to you upon delivery of the Products to the carrier.
 
Shipping costs will be calculated and displayed at checkout. You are responsible for ensuring that the delivery address is accurate and that someone is available to receive the delivery.

8. Returns, Refunds, and Cancellations

a. Returns

 

If you are not satisfied with your purchase, you may return eligible Products within [Number] days of receipt, provided they are unused, in their original packaging, and in re-saleable condition. •Impersonating any person or entity or falsely stating or otherwise misrepresenting your affiliation with a person or entity.
•Attempting to gain unauthorized access to the Site, other accounts, computer systems, or networks connected to the Site.

11. Disclaimers and Limitation of Liability

THE SITE AND ALL PRODUCTS AND SERVICES DELIVERED TO YOU THROUGH THE SITE ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT ANY REPRESENTATIONS, WARRANTIES, OR CONDITIONS OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING ALL IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, MERCHANTABLE QUALITY, FITNESS FOR A PARTICULAR PURPOSE, DURABILITY, TITLE, AND NON-INFRINGEMENT.
 
IN NO EVENT SHALL GAMO, ITS DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, INTERNS, SUPPLIERS, SERVICE PROVIDERS, OR LICENSORS BE LIABLE FOR ANY INJURY, LOSS, CLAIM, OR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING, WITHOUT LIMITATION LOST PROFITS, LOST REVENUE, LOST SAVINGS, LOSS OF DATA, REPLACEMENT COSTS, OR ANY SIMILAR DAMAGES, WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR OTHERWISE, ARISING FROM YOUR USE OF ANY OF THE SERVICE OR ANY PRODUCTS PROCURED USING THE SERVICE, OR FOR ANY OTHER CLAIM RELATED IN ANY WAY TO YOUR USE OF THE SERVICE OR ANY PRODUCT, INCLUDING, BUT NOT LIMITED TO, ANY ERRORS OR OMISSIONS IN ANY CONTENT, OR ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF THE USE OF THE SERVICE OR ANY CONTENT (OR PRODUCT) POSTED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE VIA THE SERVICE, EVEN IF ADVISED OF THEIR POSSIBILITY.

12. Indemnification

You agree to indemnify, defend, and hold harmless GAMO and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns, and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the United Arab Emirates, as applied in the Emirate of Dubai. Any disputes arising out of or in connection with these Terms, including any question regarding their existence, validity, or termination, shall be referred to and finally resolved by the courts of Dubai, United Arab Emirates.

14. Changes to Terms

We reserve the right, at our sole discretion, to update, change, or replace any part of these Terms by posting updates and changes to our Site. It is your responsibility to check our Site periodically for changes. Your continued use of or access to our Site following the posting of any changes to these Terms constitutes acceptance of those changes.

15. Severability

In the event that any provision of these Terms is determined to be unlawful, void, or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms, such determination shall not affect the validity and enforceability of any other remaining provisions.

16. Entire Agreement

The failure of us to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. These Terms and any policies or operating rules posted by us on this Site or in respect to the Service constitutes the entire agreement and understanding between you and us and govern your use of the Service, superseding any prior or contemporaneous agreements, communications, and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms).
